CastBandit Fulfilment Policy

Provider: Unhinged Studio ("Unhinged Studio," "we," "us").

1) What You Are Purchasing

CastBandit is a Software-as-a-Service (SaaS) subscription that lets you create AI chatbots from podcast content you own or are authorized to use. You are purchasing time-limited access to hosted functionality and quotas (e.g., podcast ingestion, transcription, embeddings, chats, team seats). You are not purchasing software to install, source code, models, or any physical goods.

2) Ordering & Account Provisioning

• Sign-Up & Plans. Create an account, choose a Free, Starter, or Pro plan, and (for paid plans) provide valid payment details.
• Payment Confirmation. Upon successful payment authorization and fraud checks, provisioning begins immediately. Most accounts are activated within minutes.
• Access Delivery. Fulfilment occurs by enabling features in your web dashboard, APIs, and embeddable widgets tied to your account/organization. We send an on-screen confirmation and may send a receipt by email. No items are shipped.
• Ownership/Permission Verification. You must submit only RSS feeds/podcasts you own or have explicit written permission to process and redeploy via chatbots/widgets. By using the Service, you consent to our right, at any time and in our discretion, to request proof of ownership/permission and to delay, suspend, or disable ingestion, processing, or embeds until satisfactory proof is provided. Failure to provide proof may result in content removal or account suspension without refund.
• Changes to Plan. Upgrades take effect on payment authorization; downgrades apply at the next renewal.

3) How We Deliver the Service

• Digital Delivery Only. Access is delivered online via our hosted platform (no physical fulfilment).
• Features Included. Ingestion from authorized RSS feeds; AI transcription; generation of transcripts/embeddings; chatbot configuration; and JavaScript widgets (mobile full-screen, desktop pop-up, desktop sidebar) with domain restrictions.
• Third-Party Infrastructure. Delivery relies on vendors such as OpenAI (AI inference/embeddings), Deepinfra (transcription), Replit (hosting/OAuth/storage), and Stripe/Autumn.js (billing). Availability may depend on these providers.
• Service Changes. We may update, add, or remove features. Beta/experimental features are provided AS IS and may be modified or withdrawn.

4) Availability & Performance

We use reasonable efforts to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, provider outages, internet issues, or abuse controls may affect availability. AI outputs can be inaccurate or misleading ("hallucinations"); you must review and verify outputs before use. The Service does not provide professional advice and must not be used in safety-critical contexts.

5) Cancellations, Renewals & No Refunds

• Auto-Renewal. Paid plans renew monthly until canceled.
• Cancel Anytime. You may cancel at any time in the dashboard; your plan remains active until the end of the current billing term and then stops.
• No Refunds or Credits. All fees are non-refundable, including for partial months, unused quotas, downgrades, or early termination, except where a refund is required by non-waivable law. We offer a Free plan so you can evaluate before purchasing.
• Overages. Usage beyond plan quotas may incur charges as described on our pricing page.
• Non-Payment/Chargebacks. We may suspend or terminate access for failed payments, chargebacks, or suspected fraud.

6) Invoices, Taxes & Currency

Fees are exclusive of taxes. Applicable taxes (e.g., VAT/Sales Tax) are added at checkout where required. Invoices/receipts are delivered electronically and available in your billing dashboard. Currency and pricing are as shown at purchase.

7) Support

We provide product and billing support via unhingedstudiohq@gmail.com. Response times may vary by plan and volume; beta features may have limited or no support.

8) Disclaimers & Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant error-free, uninterrupted operation or the accuracy of AI outputs. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR ANY DAMAGES WHATSOEVER, INCLUDING INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, REPUTATION, DATA, OR BUSINESS INTERRUPTION, even if advised of the possibility. If liability cannot be excluded, it is limited to the lesser of (a) amounts paid in the 12 months before the claim or (b) USD $100; for Free plans, our aggregate liability is USD $0.

UK/EEA carve-outs: Nothing excludes or limits liability for fraud, fraudulent misrepresentation, or death/personal injury caused by negligence, or any liability that cannot be limited under applicable law.

9) Relationship to Terms & Privacy

This Fulfilment Policy forms part of, and is governed by, the CastBandit Terms of Use and Privacy Policy. If there is any conflict, the Terms of Use control.

10) Changes to this Policy

We may update this policy to reflect changes in our services, vendors, or laws. Updates take effect upon posting with a new Effective Date. If you do not agree, cancel before your next renewal.
